(1) ET Auto International owns or has the right to use the intellectual property rights in all services developed or co-developed by ET Auto International, which are protected by applicable intellectual property, copyright, trademark, service mark, patent or other laws.

(2) ET Auto may make copies of posted content and may disclose content as required by law to

(a) Comply with legal process;

(b) To enforce the Terms of Service;

(c) To respond to claims that posted content violates the rights of third parties;

(d) To protect the rights, property, or safety of ET International Automotive, its users and the public;

(e) ET Auto and its designees will have the right to remove any Content that violates the laws or regulations of China, the TOS, or any other Content that ET Auto deems unacceptable.

(3) You agree that ET Auto has a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, and fully sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works based on, distribute, perform, and display such content (in whole or in part), and/or to compile such content into any other form. and/or incorporate such content into any other form of work, media, or technology, whether now known or later developed.

(4) ET International Automotive assumes no responsibility or liability for the deletion or storage failure of any messages and other communications or other content retained or transmitted through the Service. ET Auto International reserves the right to cancel suspended accounts that have not been reactivated after an extended period of time and may change these general practices and limits at any time in its sole discretion, with or without notice. ET Auto International reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. ET Auto will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. ET Auto International may terminate any account (or portion thereof), or suspend use of the Service, and remove and discard any Content on the Service, for any reason whatsoever, including, but not limited to, non-use or violation of the TOS.

As a user of the ET International Auto Service, you are responsible for:

(1) Provide true, accurate, current and complete personal information at the time of registration and maintain and promptly update said information to keep it true, accurate, current and complete. ET International Automotive cannot and will not be liable for any loss or damage arising from your loss of your identification number and password.

(2) Responsible for any content that you upload, post, send or otherwise transmit through the ET International Automotive Services. ET International Auto does not control the Content posted through the Service and, therefore, does not guarantee the accuracy, completeness or quality of such Content. Under no circumstances will ET Auto International be liable in any way for any Content, including, but not limited to, any errors or omissions in the Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, sent, or otherwise transmitted via the Service.

(3) not upload, post, email or otherwise transmit Content that is unlawful, harmful, threatening, abusive, harassing, tortious, insulting, vulgar, obscene, defamatory, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise unacceptable, or which you do not have the right to transmit.

(4) upload, post, send or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, ‘junk mail’, ‘chain letters’, ‘pyramid games’, or any other form of such marketing, except for areas specifically designated for such purposes with the permission of ET International Automotive.

(5) Not to interfere with or disrupt the Service, servers or networks connected to the Service, or violate any requirements, procedures, policies or rules of networks connected to the Service. You shall also comply with applicable Chinese laws and regulations, including but not limited to the Measures for the Administration of Internet Information Services and the Decision of the National People’s Congress on the Maintenance of Internet Security.

(6) agree to indemnify and hold harmless ET International Automotive, its subsidiaries, affiliates, officers, agents, co-promoters, or other partners, and employees, from and against any claim or demand, including reasonable attorneys’ fees, alleging or resulting from any Content submitted, posted or transmitted by you through the Service, your use of the Service, your connection to the Service, any violation of the Terms of Service by you or your violation of any rights of any other person. including reasonable attorneys’ fees, and to indemnify you against such claims or demands.

7) Not to reproduce, sell, resell or exploit for commercial purposes any portion of the Service, use of the Service or access to the Service.

(8) Upload, post, send or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary right (‘Rights’) of another.

Your use of the Service is at your sole risk. the service is provided on an ‘as is’ and ‘as available’ basis. ET International Automotive expressly disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement.

You expressly understand and agree that ET Auto will not be liable for any direct, indirect, incidental, special, consequential or punitive damages (even if ET Auto has been advised of the possibility of such damages) for any loss of profits, goodwill, loss of use, loss of data or other intangible losses arising out of or in any way connected with

(I) the use or inability to use the service;

(II) the cost of procurement of any goods, materials, information or services purchased or obtained, or information received, or substitute goods and services derived from transactions conducted through or from the Service;

(III) Unauthorised access to or alteration of your transmissions or information;

(IV) statements or conduct of any third party on the Service;

(V) Other matters relating to the Service;

(VI) ET International Automotive assumes no responsibility or liability for the accuracy, usefulness or availability of any information transmitted through the Service, or for any business transactions or investment decisions based on such information.

Your correspondence, business dealings or participation in promotions or advertising relationships through the Service, including, without limitation, the delivery of or payment for related products or services, and any other terms, conditions, warranties or representations, are solely between you and such advertisers. You agree that ET International Automotive will not be liable for any loss or damage of any sort incurred as the result of any such representations made by any advertiser on the Service.
